Yes, you do have to sue her.
Create the police report (hopefully you already have) and then use that against her in court.

you cant go to small claims court its for $2000 and under, just let her know that if she doesnt pay for the damages then you will be suing her for the damages and pressing charges for theft, usually when you say you are pressing criminal charges people cooperate but if she doesnt its her fault. and your police should apprehend her cause u reported is as theft.

Take pictures of the damage and take her to court to sue her. She stole your wallet, and they should be doing something about that.
She's also damaged property that wasn't hers and I'm pretty sure that's illegal here (I dont know about CA).
All you can do is take her to court bud and get yourself a good lawyer.

You would have to sue to get back damages from the property, but I would think the stolen wallet part would be a police issue. And couldn't she be charged with vandalism for the destruction of property? I guess I'm confused too. Talk to a lawyer. I don't think you can go through small claims court. Don't those have a limit of $2000?

If she lived with you it'd be a civil matter. They could take it to a prosecutor to see about melicious destruction of property. You most likely will have to sue.

First, file a police report and give them any proof that she did it. That's the criminal side of the complaint. On the civil side you should sue her in small claims court. No lawyers, just you, her, and a judge. Just like "The People's Court"
